The Paris prosecutor’s office requested a dismissal on Wednesday as part of the investigation into accusations of rape targeting the current Minister of the Interior Gerald Darmanin, he confirmed Thursday, January 13 to franceinfo, confirming information by BFM TV. It is now up to the examining magistrate to order a dismissal or to send Gérald Darmanin all the same to justice.

“We take note of this indictment of dismissal and await the final decision of the investigating magistrate”, commented the lawyers of Gérald Darmanin, Masters Pierre-Olivier Sur and Mathias Chichportich to franceinfo.

The investigating judge closed the investigation into the rape accusations against the Minister of the Interior Gérald Darmanin September 9 and awaited the conclusions of the prosecution to render its decision. Gérald Darmanin is placed under the status of assisted witness in this judicial information.

Sophie Patterson-Spatz has already lodged a complaint twice, in 2017 and 2018, against Gérald Darmanin, whom she accuses of having dangled her help to revise a conviction in exchange for sexual favors in 2009, when he was responsible for mission in the service of legal affairs of the UMP. In this case, Gérald Darmanin confirmed having had a sexual relationship with the complainant but disputes any constraint and any consideration.

The first complaint was dismissed by the Paris prosecutor’s office. The second with the constitution of civil party, which leads to the quasi-automatic opening of a judicial investigation, encountered the refusal of an examining magistrate to resume the investigations. But in June 2020, the Paris Court of Appeal ordered the resumption of these investigations. Gerald Darmanin filed a complaint for slanderous denunciation.
