delivery man repeated ‘I’m suffocating’ several times as he was arrested, new footage reveals

New images published Tuesday, January 25 by Release document the last moments of Cédric Chouviat, 42-year-old delivery man and father, who died in Paris two days after a police check carried out on January 3, 2020. Hospitalized in critical condition, he was declared dead on January 5.

In these images, captured by the delivery man’s phone, we hear him say that he “choking” as he is tackled to the ground by police officers. So far, the police have always denied having heard the cries of agony of the victim.

At the start of the long video of just over three minutes, we hear in particular the exchange between a police officer and Cédric Chouviat after the arrest and the verbalization of the latter. “That’s how you like to fine people, it’s your job”, says, at first, Cédric Chouviat, who films the police after being fined. “Yes sir, you put oil on your plate on purpose to hide it”, replies the policeman. “You don’t even know that. Please don’t touch me. My scooter is dirty, my plate is dirty, and yes”, answers Cédric Chouviat.

Then the exchange becomes tense on both sides. It was then that the police tackled Cédric Chouviat to the ground. “I stop. Hey, I’m suffocating. I choke. I choke. I’m suffocating…” repeats the delivery man nine times.

The day before these revelations, a new medical report on the death of Cédric Chouviat confirmed the responsibility of the three police officers, leaving the question of their voluntary character to the investigating judge.

In this document dated January 8, the five medical experts appointed by the judge retain as the cause of death a “simultaneous combination of several factors” stemming from gestures of interpellation having “resulted in a very rapid deprivation of oxygen to the brain”.

Neither the gestures of interpellation when he was still standing nor his fall “caused by discomfort”, according to experts.

A reconstruction of the events must take place

“The problem arises from the moment when the victim, obese with a short neck and a helmet on the head attached under the chin, finds himself in a ventral position with support and support in the dorsal region, a forearm passed forward of the neck that lifts the body to free the arms and bring them behind the back, in a general atmosphere of stress with opposition and struggle”, they summarize in one sentence.

For them, it was on the ground that the death of Cédric Chouviat was played out: the movement back and forth of the“forearm under the chin” would have generated a “mechanical crushing of the trachea” and some “carotid”.

As specified Release, it remains to be seen whether the police heard the words of Cédric Chouviat, recorded by the microphone of his helmet.

To find out if the police were able to hear the delivery man’s cries of agony, which they dispute, a reconstruction of the events, which should insist on the auditory aspect, should be organized soon, according to indications from concordant sources. to Agence France-Presse (AFP).

A requalification of the facts could then be played out in “intentional violence resulting in death”, a crime punishable by assizes, as requested by the family.

Asked about the new medical expertise, Me Laurent-Franck Lienard, lawyer for two of the police officers, declined to comment. Me Thibault de Montbrial, the lawyer for the other two, did not respond to AFP.
