[PASS VACCINAL] Since January 24, possession of the vaccine pass is now compulsory in order to access restaurants, cinemas, swimming pools and interregional transport in particular.

It replaces the health pass implemented last summer. The stated objective is to encourage the most reluctant to get vaccinated. It is now necessary to justify a vaccination status, booster dose included, to access interregional transport, restaurants, leisure establishments, etc. (read below). The vaccination pass does not apply for access to the hospital in the event of an emergency. This new obligation concerns all the elderly over 16 years old. Nine million French people risk losing their vaccination pass on February 15 if they do not receive an injection of vaccine against the coronavirus, warned the Minister of Health, Olivier Véran, at the microphone of LCI. ​​​​​Last week, the government also announced a schedule for easing health restrictions. From Wednesday February 2, “all sports and cultural equipment will be able to recover operation at full capacity”. Telework will no longer be mandatory on this date, but will remain recommended. Wearing a mask will no longer be required outdoors. From Wednesday February 16, consumption in transport will be authorized and nightclubs will be able to reopen. The health protocol in schools will be reassessed.

Where can you find your vaccination pass on Ameli?

After each injection, everyone must receive a certified certificate in paper format from the healthcare professional. This same document can be downloaded from the attestation-vaccin.ameli.fr website, by logging in via France connect (using your tax ID for example). You do not have no steps to take to convert your health pass into a vaccination pass. The QR code and the certificate remain valid.

“For people who are vaccinated and up to date, they have the automatic transformation of the health pass into a vaccination pass, there is nothing to do”, confirmed Olivier Véran at the microphone of LCI. “Their daily life has absolutely not changed. For people who have two doses, this is the main message that I would like to convey: there are still nine million French people who, on February 15, if they do not do not receive a vaccine injection could lose the benefit of the pass. The vaccination pass, from what age? 16 years old ?

The vaccination pass concerns all French people aged 16 or over. For minors aged 12 to 15, the health pass (a negative Covid test, a full vaccination certificate or a recovery certificate) will remain valid and compulsory to access the various activities (bars, restaurants, cinemas, etc.).

When will the vaccination pass be implemented?

The vaccination pass was implemented on Monday, January 24. As a reminder, the government initially expected effective implementation on January 15. The deadline was however postponed, the debates in Parliament being slowed down by the opposition. The left had also planned two different appeals to the Constitutional Council, in order to guarantee respect for “fundamental freedoms”, postponing the promulgation of the text of the law for a few days.

Are two doses enough to obtain the vaccination pass?

The vaccination pass requires having a complete vaccination status, booster dose included. Very concretely, you must therefore be in one of the following situations:

  • Have a vaccination certificate (a complete vaccination schedule, a booster dose within the time limit, i.e. four months after the second injection from February 15, for people from 18 years and 1 month who are eligible) ;
  • Have carried out a virological screening examination which does not conclude that contamination with covid-19 is present;
  • Be in possession of a certificate of reinstatement for more than 11 days and less than six months;
  • Hold a certificate of contraindication to vaccination.

As recalled by the Health Insurance on its website, the protection of the vaccine decreases over time. This is the reason why it is necessary to carry out a recall. “The date of eligibility for the booster is calculated: either from the date of the last injection of the initial vaccination scheme (also called primary vaccination); or from the date of the positive test for Covid-19 if the person has had Covid-19 since his vaccination”, we recall. “The booster dose is to be carried out 3 months after the last injection or infection with Covid-19“.

Since January 15, 2022, the booster dose must have been taken within seven months of the last injection, in order to maintain a valid pass. As of February 15, this period will pass up to 4 months after the last injection.

If the person does not call back within the time allowed, his pass is deactivated. If she performs a booster dose beyond the deadline, a new QR code will be generated and this new pass will be valid one week after the injection. If the person carries out the reminder within the deadlines, the QR code generated during the previous vaccination will remain valid for seven days, so that they keep their pass without cutting. In all cases, seven days after the injection, it is the QR code of the booster vaccination which will act as a pass and which must be presented.

Plane, leisure… What are the activities covered by the vaccination pass?

All establishments hitherto concerned by the health pass are now subject to the vaccination pass:

  • Hobbies
  • Restaurants and bars, except collective catering
  • Trade fairs, seminars and trade shows
  • Department stores and malls
  • Interregional public transport (planes, trains, coaches), except “for compelling family or health reasons”.

However, some exceptions are provided for, in particular a trip for a compelling reason. A simple sanitary pass will then be sufficient. Only health facilities and services will be accessible through a single negative test. Employees working in the sectors mentioned above will be required to have a vaccination pass.

Can the vaccination pass be required as part of my job?

The vaccination pass does not become compulsory in all companies in France. On the other hand, employees who were until now subject to the health pass (restaurants, cafes, bars, cinemas, etc.) must now present a valid vaccination pass to continue to exercise their professional activity. Do not panic however, the text of the law provides for the conditions under which “a proof of commitment to a vaccination scheme is worth proof of vaccination status”, can we read.

What does the vaccination pass change for the company?

In addition to the implementation of the vaccination pass, the text of the law enacts other provisions in order to fight against fraud. The managers of the places and activities subject to the vaccination pass will be able to check the pass, and if necessary, the identity of the holder of the pass, “when there are serious reasons to believe that the document presented does not relate to the person who gave it. present”. The lack of control in an establishment open to the public will be punishable by a fine of 1,000 euros, from the first violation.
The presentation of a vaccination pass belonging to others exposes you to a fixed fine of 1,000 euros, against 135 euros at present.

Possession of a false pass will be punishable by five years’ imprisonment and a fine of 75,000 euros. Companies that do not play the telework game may be sanctioned with an administrative fine of up to 500 euros per employee, up to a limit of 50,000 euros.

Until when is the vaccination pass compulsory?

The Prime Minister specified that the pass could be lifted in the event of a decline in the epidemic. “As soon as the hospital pressure is low enough (…), we can confidently lift a certain number of measures which today aim to protect us and which would be deemed disproportionate”, added the Minister of Health, Olivier Veran. “We will apply the health pass for as long as necessary, but not longer than necessary”.

Asked again about the end of the application of the vaccine pass on Tuesday January 25, Olivier Véran indicated that it will not intervene at the beginning of February. “The vaccination pass is a tool that we still need,” he said. “I am not telling you that we are in a position today to lift the pass. We will keep it as long as there is a threat hanging over our hospitals. (…) Today, there are 3,770 patients in intensive care”.

What is the health pass?

The health pass is a control system put in place as part of the fight against the Covid-19 epidemic. It aims to certify that the person presenting it is not a carrier of the virus. It must be presented by anyone from 12 years and two months to access most events of daily life: sport, culture, restaurants, entertainment, as well as to travel via main lines or within the European Union. Three documents can be presented as part of the health pass:

  • A certificate of recovery: this is proof that the person was infected with Covid-19 less than six months ago and is therefore immune. Concretely, it is a positive RT-PCR or antigen test dating from eleven days to six months
  • A negative PCR or antigen test: it must be less than 24 hours old (72 hours for PCR tests and 48 hours for antigen tests in the event of travel to another country in the European Union, but 24 hours from one of these countries). For activities in France, self-tests are authorized if carried out under medical supervision
  • A vaccination certificate: to be valid, it must correspond to a complete vaccination schedule.

The health pass should be transformed in 2022 into a vaccination pass. The government announced in mid-December that it would table a bill to this effect in early January. This finally happened at the end of December, and the legislative process is underway. The government hopes that the adoption will be effective on January 15. The health pass would then disappear, but to be replaced by a more restrictive device. It would however remain active in a few situations, access to care and minors in particular.
